With the registration of the design you can protect the appearance and physical shape of your products: you can register a tridimensional object such as piece of furniture, a scarf, a jewel, or a bidimensional object such as a graphic symbol, a decoration or a drawing on fabric, a texture.

Design protection also includes the protection of virtual ornamental elements such as the layouts of electronic platforms and web pages or the graphic interfaces of apps for smart devices.

Characteristics

Subject matter of registration can be the designs and models that are new, licit that means not in contrast with the law, public order and public morality, and that have individual character:

Novelty: A design is new if no identical design has been disclosed before it. If two designs differ only in immaterial details, they will still be considered identical.
Individual character: A design possesses individual character if the overall impression conveyed to the informed user differs from that conveyed by any other previous designs. The informed user is not a professional of the sector but a consumer that is interested in that specific business sector.
Licit: not in contrast with the law, public order and public morality.

During the application stage, the presence of novelty and individual character will not be verified and the registration is easily achievable. Nonetheless, the real value of the registration depends on the level of novelty and individual character of your design/model.

The validity of the registration for designs and models is 5 years and the registration can be renewed for a maximum of 25 years.

It is essential to know that design protection is territorial, i.e limited to the territory in which the design is registered in.

Depending on the territory in which you are interested in having protection, you can choose whether to apply for

an Italian national application at the UIBM (Ufficio Italiano Brevetti e Marchi)
an European application at the EUIPO (European Union Intellectual Property Office) or
an International application at the WIPO (World Intellectual Property Office) whether the Countries of interest are member states of the Hague System for the international registration of industrial designs.
If instead you are interested in registering a trademark outside Europe and the Hague System or if you are simply interested in just one or a few Countries and you don’t want to proceed with the European or International registration, you can proceed with a direct application at the National Offices of those Countries you are interested in.

When filing the application for a design/model it is fundamental to show precisely and specifically all the features of the product. The graphic representation must be as faithful as possible to the real product because the graphic elements you attach to the application will determine the limits of the protection of your design.
