The earlier you know, the better…


Once you have chosen your trademark, what you should know before taking any action is if there are already existing identical or similar registered trademarks in the territory you would like to protect your trademark in, and if those are registered for the same classes of products and services.
If you decide to file an application without a trademark search, you risk to receive an opposition against your trademark by the owner of an existing trademark. You may also risk a rejection of your application will be rejected by the competent Trademark Office.

This can be a way for you to avoid higher costs arising from the eventual litigation or opposition as well as the cancellation of your application.
By then, if you have already made investments in marketing, websites, communication or promotional activities, you are going to waste it all.

Trademark search. What is that?


It is not mandatory, but it is advisable to conduct a trademark search on the competent Offices’ databases before applying for the registration of a trademark. 

The Google search, which perhaps you or your graphic designer have done, will might tell you that that a name is, maybe, used by someone else, somewhere not better identified and that it is well positioned on search engines. You won’t know though if that mark sign has been registered as a trademark, if yes and if so in which Countries where and for which products. These details are the main ones you must know if you want be the owner of a valid trademark.

There are different types of searches with different costs. We will analyse the results we obtain to understand if it is convenient to apply for the registration of the trademark you chose or to change it to realize a stronger one.
